1. Acceptance of Terms
By accessing and using the EARTH365 platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including donors, NGOs, field staff, and administrators.
2. Description of Services
EARTH365 provides a platform for environmental conservation, including but not limited to: tree planting project management, carbon credit trading, NFT marketplace, MLM referral system, community forums, educational content, and DAO governance. We facilitate connections between donors and verified environmental organizations.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use. Users must be at least 18 years old to create an account.
4. Donations and Payments
All donations are processed through secure third-party payment providers (Stripe, ZarinPal, OxaPay). Donations are generally non-refundable unless a project is cancelled. A platform fee (currently 3%) is deducted from donations to support platform operations. Tax receipts are provided where applicable.
5. MLM and Referral System
The MLM commission system operates on up to 7 levels depending on your subscription plan. Commissions are calculated based on verified donations made by your referral network. Withdrawals are subject to minimum thresholds and verification. EARTH365 reserves the right to suspend accounts engaged in fraudulent referral activity.
6. Carbon Credits and NFTs
Carbon credits are verified by independent auditors and comply with international standards. NFTs represent digital certificates of environmental impact and are minted on supported blockchains. Carbon credit trading is subject to market conditions. EARTH365 does not guarantee investment returns on carbon credits or NFTs.
7. NGO Obligations
Registered NGOs must provide valid documentation and undergo verification. NGOs must submit regular field reports with photographic evidence and GPS coordinates. Failure to comply with reporting requirements may result in suspension. All funds received must be used for the stated project purposes.
8. Intellectual Property
All content, design, and technology on the EARTH365 platform is owned by EARTH365 or its licensors. Users retain ownership of content they create but grant EARTH365 a license to use it for platform purposes. The EARTH365 name, logo, and branding are trademarks.
9. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information. We comply with applicable data protection regulations including GDPR.
10. Limitation of Liability
EARTH365 is provided 'as is' without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you have paid us in the past 12 months. We do not guarantee specific environmental outcomes from projects.
11. Changes to Terms
We may update these terms at any time. Continued use of the platform after changes constitutes acceptance. We will notify users of significant changes via email or platform notification. The current version always applies.
